Elusive Customs - Comprehensive Terms and Conditions Agreement

1. Agreement Overview


This document represents a legally binding agreement (the "Agreement") between the user ("Client" or "you") and ELUSIVE WRAPS PTY LTD trading as Elusive Customs ("Elusive Customs," "we," or "us"), (ABN 16 649 298 386). By accessing our website or utilising our services, you acknowledge that you have read, understood, and agree to comply with the terms and conditions outlined herein.

2. Definitions


(a) "Services": refers to the car wrapping and any car customisations or other services provided by Elusive Customs.
(b) "Vehicle": pertains to the client's automobile, which may undergo services as detailed in the Agreement.

3. Scope of Services


Elusive Customs specialises in the application of car wraps and other customisation services. The scope of services provided is outlined in individual service contracts agreed upon by both parties, either in agreement by verbal discussion and thereby verbal contract, or by a job form otherwise referred to as a contractual agreement.

4. Vehicle Storage Policy


(a) Post-Completion Period: In the event that the client leaves their vehicle at Elusive Customs' workshop for more than seven (7) days following the completion of services, and fails to respond to Elusive Customs' three (3) attempts of contact via text message, phone call, or email:

(i) Vehicle Placement: Elusive Customs retains the right to move the client's vehicle to any reasonable location outside the confines of their workshop at its sole discretion, absolving Elusive Customs of any associated liability.

(ii) Limited Liability: Elusive Customs explicitly disclaims responsibility for any theft or damages incurred after the client's vehicle has been moved to a street parking location.

(iii) Communication Attempts: Elusive Customs commits to making reasonable and documented attempts to contact the client through multiple channels of communication before implementing this policy.

(iv): Unregistered Vehicles: Any registered vehicles which become unregistered (registration/vin) or are already unregistered (registration/vin) in and during the servicing period provided by Elusive Customs, automatically exempt us, Elusive Customs from the liability, either to theft or damage. As such, Elusive Customs assumes no responsibility or liability for all unregistered vehicles (registration/vin), within and beyond the workshop.

5. Payment Terms


(a) Client Obligation: Clients are obligated to make payments as stipulated in the individual service contract or verbal agreement. Failure to make timely payments may result in additional charges or project delays.

(b) Payment Disputes: Disputes related to payments will be resolved through negotiation, and if necessary, through mediation or legal action.

6. Cancellation and Refund Policy


(a) Client's Right to Cancel: Clients may not cancel services after having agreed, by either verbal or written contract, to the actioning of any services provided by Elusive Customs. 

(b) Refund Process: Refunds, if applicable, will be processed in accordance with Elusive Customs' internal policies which can be discussed and negotiated but at no guarantee of any return.

7. Warranty Provisions


(a) Limited Warranty: Elusive Customs provides a limited warranty on services performed. The terms and conditions of this warranty can be discussed upon the request of service provided, and otherwise can be discussed at the discretion of the team at Elusive Customs.

8. Client Responsibilities


(a) Accurate Information: Clients are responsible for providing accurate and up-to-date information necessary for the provision of services.

(b) Timely Response: Clients are required to respond promptly to communication from Elusive Customs to facilitate efficient service delivery.

(c) Vehicle Pickup: Clients are expected to retrieve their vehicles promptly upon completion of services, as outlined in the service contract.

9. Dispute Resolution:


(a) Negotiation and Mediation: Any disputes arising from this Agreement shall be resolved initially through good-faith negotiation and, if necessary, through mediation.

(b) Legal Action: If resolution through negotiation and mediation is unsuccessful, either party may pursue legal action in accordance with applicable laws.

10. Amendments to the Agreement


(a) Modification Rights: Elusive Customs reserves the right to modify the terms and conditions of this Agreement at any time. Clients may not be notified of changes and must keep up to date at their own discretion. The continued use of our services implies acceptance of the updated terms.

11. Governing Law


(a) Applicable Law: This Agreement is governed by and construed in accordance with the laws of NSW, without regard to its conflict of law principles.
